1. Acceptance of Terms
By accessing or using the Moody Teas website (shop.moodyteas.co), placing an order, or purchasing any products from Moody Teas in person or online, you agree to be bound by these Terms & Conditions and our Privacy Policy, which is incorporated herein by reference. If you do not agree, please do not use our website or services.
These Terms apply to all visitors, customers, and others who access or use our services. Moody Teas reserves the right to update these Terms at any time without prior notice. Your continued use after changes constitutes acceptance of the revised Terms. The most current version will always be available at shop.moodyteas.co.
IMPORTANT: These Terms contain a binding arbitration clause and class action waiver in Section 13. Please read that section carefully as it affects your legal rights.
2. Products & Descriptions
We take care to accurately describe our teas, blends, and related products. However, we do not warrant that product descriptions, ingredient lists, or other content are error-free, complete, or current. Product availability and pricing are subject to change without notice.
Allergen & Cross-Contamination Warning:
Our products are produced in a facility that handles common allergens including but not limited to tree nuts, soy, and gluten. While we take precautions, we cannot guarantee that any product is completely free from allergens or cross-contamination. Customers with known food allergies or sensitivities assume all risk associated with the purchase and consumption of our products. If you have questions about specific ingredients, contact us at hello@moodyteas.co before purchasing.
Our products are not intended to diagnose, treat, cure, or prevent any disease or health condition. Nothing on this website or in our marketing materials constitutes medical advice. Consult a qualified healthcare professional before using our products if you have a medical condition, are pregnant, or are taking medications.
This disclaimer extends to any customer testimonials or reviews we may publish. Testimonials reflect individual experiences and are not representative of typical results.
3. Orders & Payment
By placing an order, you represent that you are at least 18 years of age and are authorized to use the payment method provided. We accept major credit and debit cards through our secure Stripe-powered checkout.
An order confirmation email does not constitute acceptance of your order. We reserve the right to refuse or cancel any order at our discretion, including for reasons such as product unavailability, pricing errors, suspected fraud, or prior violations of these Terms. If payment has already been processed at the time of cancellation, we will issue a full refund to the original payment method.
Illinois sales tax (Cook County/Chicago, currently 10.25%) will be applied to applicable orders as required by law. Tax rates are subject to change in accordance with applicable law.
If you have a question about a charge, contact us before initiating a chargeback. Unwarranted chargebacks may result in suspension of your account.
4. Subscription & Auto-Renewal Orders
If Moody Teas offers subscription or recurring order products, the following terms apply in accordance with the Illinois Automatic Contract Renewal Act (815 ILCS 601):
• You will be clearly informed of the recurring charge and billing frequency before subscribing.
• Your subscription will automatically renew at the end of each billing period unless cancelled.
• You may cancel your subscription at any time before the next billing date by contacting us at hello@moodyteas.co or through your account dashboard.
• Cancellations after a billing date has processed will take effect at the end of the current billing period; we do not provide prorated refunds for subscription periods already billed.
• We will provide advance notice of any material changes to subscription pricing or terms.
5. Shipping & Delivery
We ship to addresses within the continental United States. Estimated delivery times are provided at checkout but are not guaranteed. Risk of loss and title for items purchased pass to you upon delivery to the carrier.
Moody Teas is not responsible for delays caused by carriers, weather, natural disasters, labor disputes, pandemics, government actions, or other circumstances beyond our reasonable control (see Section 14, Force Majeure).
If your package is lost or arrives damaged, contact us within 7 days of the expected delivery date. We will work with the carrier to resolve the issue. We are not responsible for packages marked as delivered by the carrier to the address provided at checkout.
6. Returns & Refunds
Our return policy is disclosed here and at checkout. Please review before completing your purchase.
Due to the perishable nature of food and beverage products, we accept returns only for items that are damaged, defective, or materially different from what was ordered. You must contact us within 7 days of delivery to initiate a return or report an issue. We may request photographic evidence of the defect.
Approved refunds will be issued to the original payment method within 5-10 business days of our receiving and verifying the claim. Original shipping costs are non-refundable unless the return is due to our error. Return shipping costs are the customer's responsibility unless we provide a prepaid label.
We reserve the right to offer store credit in lieu of a refund at our discretion, unless otherwise required by applicable law.
7. Gift Cards & Store Credit
Gift cards and store credit issued by Moody Teas are subject to the following terms, consistent with Illinois law:
• Gift cards do not expire and are not subject to dormancy fees.
• Gift cards are non-refundable and cannot be redeemed for cash except as required by law.
• Lost or stolen gift cards cannot be replaced. Treat them like cash.
• Moody Teas is not responsible for unauthorized use of gift card codes.
• Unused gift card balances may be subject to Illinois unclaimed property (escheat) law after the applicable dormancy period.
8. Farmers Market Sales
Purchases made in person at farmers markets and other events are final sale unless the product is visibly defective at time of purchase. Please inspect your items before leaving the market. We accept cash, card, and mobile payment at market events. All applicable taxes will be collected at point of sale.
By providing your contact information at a market event, you consent to being added to our customer database and may receive occasional communications from us. You may opt out at any time.
9. Intellectual Property
All content on this website, including but not limited to text, images, logos, brand names, blend names (including those developed under the BLEND Manager system), graphic design, and marketing copy, is the exclusive property of Moody Teas and is protected under applicable United States copyright and trademark law.
You may not reproduce, distribute, modify, display, or use any of our content for commercial purposes without prior written permission. Unauthorized use may result in legal action.
10. Disclaimer of Warranties
OUR WEBSITE AND PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED/ERROR-FREE SERVICE.
We do not warrant that the website will be free of viruses or other harmful components, or that defects will be corrected. We make no representations about the suitability, reliability, availability, timeliness, or accuracy of the content on this site.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MOODY TEAS AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OUR PRODUCTS OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability for any claim arising out of or related to a product purchase shall not exceed the total amount you paid for the specific product giving rise to the claim in the twelve (12) months preceding the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless Moody Teas and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of or access to our website or products; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any claim that your use of our products caused damage to a third party.
13. Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Informal Resolution: Before initiating any formal dispute, you agree to contact us at hello@moodyteas.co and give us 30 days to attempt to resolve the issue informally. Most concerns can be resolved this way.
Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or our products and services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration will take place in Cook County, Illinois, or via video conference by mutual agreement. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Small Claims Exception: Either party may bring an individual claim in small claims court in Cook County, Illinois, if the claim qualifies under that court's jurisdictional limits.
Class Action Waiver: YOU AND MOODY TEAS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.
You may opt out of this arbitration agreement by sending written notice to hello@moodyteas.co within 30 days of first agreeing to these Terms. Opting out does not affect any other provision of these Terms.
14. Force Majeure
Moody Teas shall not be liable for any failure or delay in performance under these Terms to the extent caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic or public health emergencies, war or civil unrest, government orders or regulations, supply chain disruptions, utility failures, labor disputes, cyberattacks, or carrier failures.
In such circumstances, we will notify you as soon as reasonably practicable and will make reasonable efforts to fulfill our obligations as conditions allow.
15. Governing Law & Venue
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Subject to the arbitration agreement in Section 13, any legal action arising out of these Terms shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction in those courts.
16. Severability & Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moody Teas with respect to your use of our website and purchase of our products, and supersede all prior agreements, representations, or understandings.
